On or about, but not before, February 17, 2015, the City of Canton will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Federal funds under Section 104 (g) of Title I of the Housing and Community Development Act of 1974, as amended; Section 288 of Title II of the Cranston Gonzales National Affordable Housing Act (NAHA), as amended; and Title IV of the Stewart B. McKinney Homeless Assistance Act, as amended; to be used for the following project(s):

Habitat for Humanity Housing Project

The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements. An Environmental Review Record (ERR) that documents the environmental determinations for these projects are on file at the above address and is available for public examination and copying, upon request, between the hours of 8:00 A.M. to 4:00 P.M., Monday through Friday (except holidays) .

The City of Canton plans to undertake the project(s) described above with the Federal funds cited above.  Any interested person, agency, or group wishing to comment on the project(s) may submit written comments for consideration to the City of Canton at the above listed address prior to February 17, 2015. 

The City of Canton certifies to HUD that William J. Healy II, in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the City of Canton to use these Federal funds for the projects described herein.

HUD will accept objections to its release of funds and the City of Canton's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Canton; (b) the City of Canton has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to: U.S. Department of Housing and Urban Development; Office of Community Planning & Development; Environmental Officer; 200 North High Street; Columbus, Ohio 43215-2499. Potential objectors should contact HUD to verify the actual last day of the objection period.
