Executive Order 2009-006
Incompatible Employment

WHEREAS, it is the Mayor’s responsibility to ensure, by policy and practice, the strict adherence to the procedures, regulations and rules of conduct set forth in the City of Canton Codified Ordinances and Work Rules; and

WHEREAS, as the Chief Executive Officer of Canton, Ohio, the Mayor is charged with the ultimate responsibility of supervising and directing the day-day affairs of City Departments and Offices as prescribed by the Ohio Revised Code and Codified Ordinances of the City of Canton; and

NOW, THEREFORE, I, William J. Healy, II, Mayor of the City of Canton, Ohio, under the authority conferred by the State of Ohio, do hereby order that City employees shall not engage in incompatible employment.

BE IT FURTHER ORDERED, pursuant to Ordinance 151.04, incorporated herein by reference, that any full-time City employee who is on injury or sick leave shall not enter into other employment nor be engaged in any outside activity from which remuneration or compensation of any type, either direct or indirect, is received without obtaining prior written permission from the Mayor of the City of Canton.

BE IT FURTHER ORDERED that all City employees engaging in any occupation or outside activity for compensation shall immediately complete an Outside Employment form, describing the time required and nature of such activity.

BE IT FURTHER ORDERED that henceforth any employee seeking to engage in any occupation or outside activity for compensation shall present the Outside Employment form for approval. For purposes of complying with this Executive Order, all correspondence shall be maintained in the Department of Human Resources. 

BE IT FURTHER ORDERED that failure to comply with this Executive Order shall constitute an act of gross misconduct pursuant to the City Wide Work Rules and shall be grounds for denial of injury or sick leave benefits and/or other such disciplinary measures as may be deemed proper.
