Drug Free Workplace

WHEREAS, the City of Canton is committed to maintaining awareness that drug abuse in the workplace endangers the health, safety and welfare of City employees, the public and other recipients of various municipal services, and that drug abuse increases tardiness, absenteeism and injuries; and

WHEREAS, the City of Canton seeks to have a drug-free workplace in accordance with the Drug-Free Workplace Act of 1988 by promoting drug-free awareness among employees through posting notices, education and discussions; and

WHEREAS, as the Chief Executive Officer of Canton, Ohio, the Mayor is charged with the ultimate responsibility of supervising and directing the day-to-day affairs of City Departments and Offices as prescribed by the Ohio Revised Code and Codified Ordinances of the City of Canton; and

NOW, THEREFORE, I, William J. Healy, II, Mayor of the City of Canton, under the authority conferred by the State of Ohio and the Federal Drug-Free Workplace Act of 1988 hereby order that the City of Canton is to maintain a drug-free workplace and employees shall sign a pledge to be maintained in their personnel files in the Department of Human Resources.

BE IT FURTHER ORDERED that the illegal manufacture, distribution, possession or use of drugs/controlled substance or acting under the influence of drugs/controlled substance in the workplace is strictly prohibited on/in any property owned, occupied or controlled by the City of Canton. In addition, illegal drug activity shall be reported to appropriate law enforcement officials.

BE IT FURTHER ORDERED that the Department of Human Resources shall coordinate drug-testing activities.

BE IT FURTHER ORDERED that the Department of Human Resources shall maintain and distribute information to employees on a confidential basis regarding drug counseling, rehabilitation, and employee assistance programs, upon the request of any employee.

BE IT FURTHER ORDERED that all City employees shall be subject to drug testing pursuant to all applicable laws, standards and applicable Collective Bargaining Agreements and Civil Service laws.

BE IT FURTHER ORDERED that each Department Head and Elected Official shall be responsible for ensuring that his/her employees are aware of the contents of this Executive Order and the information available through the Department of Human Resources.

BE IT FURTHER ORDERED that appropriate disciplinary actions, which may include termination, will be taken against City of Canton employees for any violations of this order.
